The Hockey Source

The Hockey Source™ was created to provide information about minor hockey to coaches, players, parents, trainers, administrators, scouts, agents, fans and anyone else involved in the sport. It is owned and operated by Fire 'n Idea Inc. (which is also referred to as "we", “our” and “us” in what follows). It is operated out of Ontario , Canada and includes this website (the “Site”) as well as a 30-minute television program (“the Show”). We want you to use and enjoy our Site and we also want to make you aware of the fine but necessary print. Well, actually, we decided to leave it in large font so that you wouldn't have to squint!

This section describes the terms and conditions that govern the use of our Site. This information is being provided to you (the “User”) so that we are in compliance with the law and so that our mutual rights and obligations are clear. The Privacy Policy available through a link on our homepage also governs your use of the Site, the content and the services.

By accessing, browsing or in any other way using the Site, you acknowledge that you have read, understood and agreed to be bound by the Terms and Conditions of use outlined below. As a condition of your use of the Site, you agree that you will not use the Site for any purpose that is illegal or in any way that is prohibited by the notices, terms and conditions set out below. If you do not agree and accept without modification the notice, terms and conditions in this document, do not access, browse or otherwise use the Site.

Content of the Site is the property of Fire 'n Idea Inc. All content on or downloaded from the Site, including without limitation, all text, graphics, photographs, design, code and software as well as the organization and presentation of these elements are the property of us and subject to intellectual property rights held by us. Use of these elements without the express permission from us constitutes a violation of the rights of our company. Use of the Site is restricted to personal, non-commercial use. The User may not reproduce, publish, transmit, distribute, display, modify, derive works from, sell or participate in any sale of, or exploit in any way the Site or any of its content. Notwithstanding, Users are permitted to copy and print hard copies of pages from the Site for their personal, non-commercial use, so long as the pages are not modified and the copy retains any copyright, trademark or logo or any copyright or trademark notice appearing on the Site.

These terms and conditions will continue as an agreement between the User and us until they are terminated by us. We may terminate this agreement without cause and without notice to the User. The terms and conditions imposed upon the User, including without limitation any disclaimers, limitations or liabilities that are described in this document, will survive the termination of this agreement. The terms and conditions described in this document constitute the entire agreement between the User and us and this agreement supersedes all prior or concurrent communications and proposals, in any form, between the User and us.

Disclaimers / Responsibility of Users

The content on the Site is provided on an "as is" basis without warranties of any kind, either expressed or implied. We specifically disclaim all warranties and conditions of any kind, including without limitation, all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. Use of the Site is at the risk of the User. We do not warrant that the content of the Site will be accurate, uninterrupted or otherwise error-free, that defects will be corrected or that the Site or server upon which it resides are free from viruses or any other harmful components. Our employees and agents will not be liable for any direct, indirect, punitive, special, incidental, or consequential damages arising out of or in any way connected to use of the Site including without limitation a delay or inability to use the Site or the content of the Site, whether based on contract, tort, strict liability or other cause of action.

WHAT THIS MEANS IS…
What you see is what you get. You can't blame us for mistakes, interruptions or defects. You can't sue us if your computer gets sick.

The User assumes the risk of electronic interactions with us through this Site. We cannot ensure or warrant the security of personal information transmitted through the Site and we ask you to consider this when deciding whether what information to provide through the Site.

Governing Law

The User agrees that use of the Site is governed by the laws of the Province of Ontario, Canada without giving effect to any principles of conflict of law. The User agrees that any claim brought against us will be brought exclusively in a court of competent jurisdiction in Ontario .

court (if you feel the need to) in Ontario , Canada .

We have made all reasonable attempts to comply with all legal requirements known to us in creating and maintaining the Site, but we make no representation that the content of the Site is acceptable or available in any jurisdiction. Users who access the Site from outside Ontario , Canada , are solely responsible for complying with any applicable local laws. If any part of this agreement is invalid or unenforceable under applicable law, the invalid or unenforceable provision(s) will be deemed to be severable from this agreement and will not affect the validity or enforceability of any remaining provisions.
